Joey Barton's assault trial at Sheffield Crown Court has been halted after a judge decided it would be unfair to continue due to technical problems and issues with translation.
The 38-year-old Bristol Rovers manager had been on trial accused of assault occasioning bodily harm against former Barnsley boss Daniel Stendel.
Stendel, who joined the Tykes in June 2018, suffered an injury to his mouth during an incident in the Oakwell Stadium tunnel following a game between his Barnsley side and Barton's Fleetwood Town.
The prosecution opened the case on Monday but the Recorder of Sheffield, Judge Jeremy Richardson QC, brought the trial to a halt following concerns over technology and fairness.
He told the jury, who he discharged this afternoon, that in his 41 years in law that he had never conducted a trial in the way he had done so in the last couple of days.
Stendel, who led Barnsley to the Championship in 2019, had been giving evidence from a courtroom in Hannover, Germany.
However, there were issues with echoes over the audio causing a problem, in turn, with questions and answers being interpreted correctly.
Judge Richardson told the jury that the electronic systems had proved to be a mixed blessing during the Covid-19 pandemic but that he became "increasingly concerned that things were getting lost in translation".
Steps are to be taken overnight to see if inquiries can be made as to the overruling of any travel restrictions in the interest of justice so that Stendel can be physically present to give evidence in the "not too distant future".
A hearing will take place tomorrow morning (Wednesday) to schedule a new start date for Barton's trial.
He denies the allegation of assault occasioning actual bodily harm.

Hopefully we won't be kept waiting too long:- Judge Richardson said it was not anybody’s fault that the trial had to be halted, but was a consequence of the extraordinary measures put in place due to the pandemic. He said a new trial date would be fixed after it could be worked out how to bring Mr Stendel to the UK to give his evidence. But the judge pointed out that the trial had already been postponed for a year because of Covid and was the oldest case on Sheffield crown court’s books. Gratuitously arranged shots of the moon and gas giants. Occasional glimpses of the Milky Way itself - leaving you to only imagine whats really there, in the vastness of space, and whatever its motivation is.

It seems to me Stendel doesn't want to attend the trial, if not, then why's he let it get this far.

Also, he does appear to be a bit accident prone, I mean, if he can't navigate a polytunnel without causing himself serious injury, just about anything could happen to the poor bloke if he tried to get from Hanover to Sheffield!

Its all just conjecture, the whole thing stinks, its definitely a case of foul play as the presumption of innocence is a legal principle that every person accussed of any crime is considered innocent until proven guilty
If reasonable doubt remains the accused must be acquitted.

Case Dismissed! UtG Would you give Barton the benefit of the doubt? He has form for this kind of cowardly attack. Its not a laughing matter, just as stubbing cigarettes out in people's eyes or attacking teenagers wasn't either. Its incredibly depressing to watch the club's fans degrade themselves by defending somebody who is an unrepentant thug and spiteful bully. He's already dragged the club's name through the mud and raised the prospect of further legal action by attacking previous managers. Its not even a Faustian pact, as he's a sh*t manager. The team last season was very poor, but they were outside of the relegation places when he arrived. By the time Joey had worked his magic, they were rock bottom. Its just laughable hearing him talking about how he hopes to recreate his 'success' at Fleetwood, Barton is utterly toxic and the sooner he is out of the club, the better. And the people who employed him (Starnes and Wael) can follow as well, because they decided to bring somebody of this calibre into the club.

I imagine JB wants this dealt with sooner than later and is probably pretty fed up with it. It’s not nice to have such stuff hanging over you and also his silk will not be cheap. I wonder if he is paying for Csoka or someine else ? I think you should save any sympathy for Stendel, as he is the victim here, not Barton. And its not as if Barton won't be fully aware of the costs of legal proceedings, having been involved in so many legal cases before. If Barton had actually acknowledged his previous actions and sought to change his ways, then there would be grounds for sympathy. As it is, he is an unrepentant thug.

Joey Barton's new trial will take place on Friday, November 26.
The Bristol Rovers manager's trial was stopped yesterday due to issues with the video link to Germany for Daniel Stendel's evidence and concerns over translation.
