The only thing I really can say from that is IF THE LAWYERS ARE SO BLOODY CONFIDENT THEN NO DOUBT THEY ARE WILLING TO DO IT ON A NO WIN NO PAY CLAUSE. Preferably a watertight one!!!

I'd like to ask him two questions: if, at any point, sainsbury's offered us a sum to settle the case? It beggars belief that they wouldn't have reduced their legal risks and mitigated bad PR by offering a couple of million quid during the process. How will the Wonga loan be repaid? Just the sort of thing 2 million quid would be useful. I believe that if one side officially offers an Out of Court settlement figure, which is not bettered by the outcome of the case, then the side who turned the offer down will be liable for all expenses. What you are referring to is a Part 36 offer: www.out-law.com/en/topics/dispute-resolution-and-litigation/settlement/part-36-offers-to-settle/ It can be tactic in litigation. If you make an offer which satisfies the conditions of Part 36 of the CPR, the other side refuses and at the end they get the same or less than the offer you get your costs. Potentially it can force settlement.

is dosnt look too good does it? but what if we win the appeal? will the forum shut down? or will everyone change there usernames. one of the questions on the club site should have read "what if we ultimately lose this case?" thats my question but i still feel people have gone overboard with there condemnation when we could still win the appeal.

We are ripe for purchase and approaches and offers will be made by people who do have the funds to build UWE and max the potential our large fan base provides.
The current board have been trying to build a state of the art new stadium for nothing! That is not a realistic plan normally and doesn't look like happening now.
What we have to remember here is that Chairman Higgs best interests and Bristol Rovers best interests are two entirely different things and any potential buyer will want to pay him as little as possible for his shares and repay as little as possible of his loans so that they have more to spend on the stadium and team. We might not get to hear of any interested parties if they don't offer what he considers adequate compensation for his shares and loans unless that is they go public anyway in order to try and exert fan pressure on Higgs & Co.
Lets hope that ownership change progresses quicker than the ill fated appeal.

Very slim chance, not before 2018, and would leave us about £10 mil short to build the stadium. Higgs would have cashed in and we'd still be playing in a dump with a rudderless club lurching from crisis to crisis. On the 95% probability that it's not as good as that and we don't win, we're doing nothing except throwing money and effort the other way. Fingers crossed the court rescues us from any more of this.

one of the questions on the club site should have read "what if we ultimately lose this case?" Wasn't that categorically answered with "that would mean the Sainsburys big guns have won"?

You'll get splinters sat on that fence. What if? Well, what if we had read the contract and understood it, then ensured that the first planning appeal was discussed with the planning officers and we understood exactly what they needed, and made sure that the appeal was submitted in a format that gave it the best possible chance of being approved. Hands up everyone who thinks that Sainsbury's will accept the findings of any appeal without dragging things through courts for as long as they are able? Even if the case were won all that means is that the contract is still in effect. No doubt Sainsbury's have a box full of other spanners ready to be thrown into the works. If they are backed into a corner and run out of options attention then turns to the content of the writ, and so the argument goes on, and on. The most interesting things to happen since losing the court case is the club including reference to residential development in the statement issed in the form of an interview by Watola,

This looks to me to be the hidden message,

This looks to me to be the hidden message, (not very well hidden, but included here for a reason I reckon) 'Yes, but Nick wouldn't make so much out of it, and that's the main focus; screw getting the football club decent facilities.' You're probably right. Mysterious hybrid alternative solution proferred for discussion. Set that hare running, but only on the quiet. That's plan B, but the loss of gain to the majority shareholder doesn't bear (him) thinking about.

What I said last season was that with the resources available and the right manager we should have won a pitiful division. Let me just check what happened last season, here we go, Barnet, managed by the man I said would win the division were promoted as champions. Maybe read my post again. Did I say that the appeal wouldn't be granted? I don't know, maybe it will, but it won't help much as enforcement of the contract will still be way way off down the road.

But apart from that I thought it was quite good. Never far from the latest farce, is he? I really don't know how the Chuckle Brothers can sleep at night having presided over the worst period in Bristol Rovers history. still at least they can depend on the support of Nurse Ratchet. They sleep very soundly safe in the knowledge that the fans will tolerate any s**t that's thrown at them.

Isn't it great that we've built so successfully on last seasons success!?
I hope that we win a couple of games early on, otherwise a huge depression will settle over The Mem!
This statement & technical issues with the kit sum it all up. More amateur than the Silver medal winner at The Open!!!!
Good luck Darrell and the footballing department!!!!

From memory, in the past Toni the Till was always portrayed as GD's man. Yet, with Higgs at the helm, he seems to be more high profile and heavily involved in the running of the club - have I misunderstood, or missed something? He belongs to whoever pays his wages which is currently Higgsy.

I wouldn't mind betting that Higgs best hope for himself is if Sainsbury's have to pay a sum not to fulfil the contract he could then get his money back and go and grow some grapes.
