"The hearing is set to begin at 10.30am and is pencilled in for five days." I'd assumed it would be done and dusted quite quickly. Same here but the legals love the money and big , expensive lunches, for anything to be quick. Unless the judge decides there is conflicting evidence or a technicality, it is never quick. In my case it was all over by 15:00 & the judge told the jury to leave prior to giving the police a massive rollicking and told them he would charge them for wasting court time by bringing such a badly formed case. He also bound over the guy who was a protagonist & fined him £300 for lying

Mr Goldsack added that the only other eye witness to provide a statement as to how Stendel came by his injuries is the Barnsley first team performance analyst intern Nathan Kirby. Mr Goldsack told the jury: “He was a few paces behind Mr Stendel as they entered the tunnel. “As he got halfway along the tunnel he felt someone brush past his right shoulder. He was surprised anyone should be running in the tunnel and turned to see who it was and recognised Mr Barton. “As the defendant passed ahead of him Mr Barton moved to his left to where Mr Stendel was walking and pushed against him from behind, whilst continuing to jog forwards. As described by Mr Kirby, a deliberate act done with enough force to knock someone off-balance, which of course is precisely what happened.” Mr Goldsack said: “The matter having been reported to the police, Mr Barton attended Barnsley police station on Wednesday, April 17, 2019, to be questioned about what had taken place. “He was arrested for the offence of assault occasioning actual bodily harm, to which he made no reply, and later that day underwent a recorded police interview assisted by his solicitor representative. “Towards the outset of that interview he provided a written prepared statement via his solicitor, after which he exercised his right to provide ‘no comment’ responses to all questions asked of him. “In his prepared statement, he accepted he had used ‘industrial language’ pitchside when at the touchline, but denied barging into or otherwise assaulting Mr Stendel when in the tunnel, and claimed to be unaware of anything untoward having taken place in that area until after he had got back to his team’s dressing room. He said had he pushed Mr Stendel over he would have known about it.” Sounds like handbags at Dawn. Really surprised this has even got to the crown level.

But in and of itself it isn't obviously a case for the Crown Court - which may, as posted here, be due to the choices of the defendantStanding at Barnsley Magistrates’ Court on Wednesday, the former England international indicated a not guilty plea to assault occasioning actual bodily harm. Given I can't recall another football manager ever being assaulted by another manager it's hardly surprising the charge was brought. Unless Barton's brief is a brilliant one you can't really see how a jury won't find him guilty, I guess as the "push" wasn't captured on film that may put doubt in the Jury's minds. Although how Wael cam still support Barton if he does get off is beyond me. Oh contrare, it’s looking like a smart call of Wael that this was all it was so no reason to avoid him because of it. Sounds like one of those days both benches wind each other up, the handbags come out. If it wasn’t for a dear bit of blood it would have got nowhere near police interview and crown court. I would say it’s looking like a smart call as well by Joey to have his day in court, where proper advocate can scrutinise it for public to see what went on that day in context. Soon as judge gets feel for how this has been bigged up to waste his time and jury, he may even dismiss jury anyway. It’s plainly obvious from the prosecutors opening remarks there isn’t anything worthy of this fuss, Dick Van Dyke committed a more serious crime with his accent in Mary Poppins.

I wouldn't be so quick to decide he'll be found not guilty. Today was only the opening statement. More detail to follow.
Maybe only one person saw what happened. But video evidence apparently corroborates his view of events. And attacking from behind is apparently JB's favoured style so it's not hard to believe he deliberately ran down that tunnel with the intention of shoving Stendel in the back.
Whether found guilty or not, he's definitely not innocent. He's a nasty piece of work who should be nowhere near this club imo.
