As I understand it then: 1) Planning meeting ratifies recommendations (if they don't they have to have a VERY good reason and are open to all sorts of legal ramifications if not) 2) Ball in Sainsburys' court - do they accept that they are now obliged to pay up or do they have further loopholes? 3) Lord knows

I'm not dancing. im with smithy on this one... dancing/celebrating about about a Rovers planning application/proposal is like spending your lottery winnings before checking your ticket (or even buying one!)

The problems arose when Nick's advisers told him the contract was like a duck's ass. He thought they meant watertight. But they really meant it was full of sh*t (sorry for the vulgarity )

They will say that it still isn't an acceptable planning permission because the cost of the noise mitigation measures are likely to be over £40,000 which makes it a store onerous condition. (Despite the fact that Rovers have said they will pay for the mitigation measures) Specifically the contract says: So doesn't say that it has to be a cost to Sainsburys even though that is clearly what is implied. Any contract lawyers out there know how that might get resolved?! Also in some other correspondence Sainsburys have said that a limit on the number of delivery lorries is another store onerous condition, something which Rovers solicitors have simply dismissed but to me sounds like the next argument down the line.

There were 2 unnamed objections added today and one yesterday. As far as I know if the Planning Committee pass the thing next week nobody can appeal so no JR or TRASH etc. this time. I have no idea what Sainsbury's will or won't do and still think a large store in that location will turn a massive profit for them. Trouble is supermarkets are acting like politicians and looking only at the short-term at the moment - Lidl and Aldi are a bit of a fad in my opinion and the media keeps hyping them up. My experience of them is that you can get some bargains, but the service is terrible, you can't use credit cards and I'll (OK my wife) will stick with the big supermarkets, thanks very much (but will buy Lidl champagne and mulled wine). My wife would be only too keen to use Sainsbury's at The Mem. It would be the nearest to home and she can't be bothered to use the local Lidl as they don't stock everything we need. At the end of the day most people still want to get their weekly shop in one go, even if it does cost more than getting some stuff at Lidl or Aldi. Still, I don't run Sainsbury's so what do I know?

Does anyone have a link to the BCC site showing the planning officers have recommended in Rovers favour? I have gone on the BCC site and still shows decision pending and not granted. Maybe the decision pending is about the overall decision but I cant see anywhere where it says the planning officers have recommended in Rovers favour.

Speculation: TRASH are well aware that Sainsbury's won't build anyway and it's purely a contractual matter between the two parties.
Having said that, they may well pop up with something typically idiotic before long
