What would you call a victory in this case? An acceptable level of compensation that enables us to move on in a decent financial position, and hopefully leading to a change of ownership. No need for talk about compensation. 4 out of 5 points are already won, demonstrate that the 5th and final point should be ruled in our favour then the contract can be enforced and we get all the dosh, plus expenses and can then move on to enforce the claims in the writ. Where's the problem? If Higgs walks away do you think he'll leave a float behind for new owners to work with?

She actually used the words "an insuperable barrier". Insuperable and insurmountable mean the same thing as far as I can tell, it's just one of those words that lawyers use to make people think they're cleverer than common folk (whereas the only difference is a private education that our parents couldn't afford). Anyway, I digress. What she meant was "The agreement is worded in such a way that you've got f-ing no chance enforcing it in this court or any other so appeal if you must but they'll agree with me too now on your way" only her opinion - sometimes lawyers do disagree you know? It's a bit more than just a random opinion though isn't it? It's the opinion of a High Court Judge after hearing two weeks of very detailed argument from both sides and after reviewing submitted evidence for weeks after the trial. The Rovers evidence included all the dirty tricks played by Saimsbury's in great detail. She listened, she reviewed the evidence and the contract, and then she decided based on law that JS were right to terminate as the cut off date had been reached. i hope I'm wrong but I think we have no chance of winning an appeal because there is no material new evidence in our favour

I have always thought that UWE would be built and have said so on numerous occasions.
I still believe it.

yeah but built by whom and owned by whom? I would like to think the new owners of BRFC (if it ever happens) would fund it, but if we pull out of the UWE build project, i fear others will build it....

I have always thought that UWE would be built and have said so on numerous occasions. I still believe it. When and how? I'm guessing both answers will have been updated over the past couple of years: what do they currently look like? It's a genuine question. When first announced, I thought it would be built and could have given a date for occupation (forgotten what it was now), but have changed my view to 'no it won't', mainly because we're chasing finance that I don't think we'll get, which wouldn't be enough to build it anyway, have been in that position now for about two years, and seemingly haven't pursued any other way of delivering it. I'd like to think it would be built and am intrigued how anyone has confidence that it will be.

If an opportunity presented itself to an investor to build a complete stadium complex with bang up to date infrastructure in place and full planning approved, i'm sure some rich company with previous experience in developing such facilities would be interested... it could happen you know ?

I believe you and Vital broke the story a week ago. The question is, who will become its tenants? No idea who is going to pay for it though.

That would be an interesting one to find an answer too... and NO I don't know the answer, just me putting 2 and 2 together and getting 5

I can go with the principle. Then again, is there any precedent for a third party developing and leasing out a stadium (rather than venue, arena etc.) in this country? As in the lead developer, holding the risk and financial model, rather than as agents for a football club, the FA etc? Would UWE be the lead? It seems a long way off though, and a very long way and frankly divorced from chasing Sainsbury's through the courts for years. I wouldn't categorise that as 'confident it will happen' (and you seem to have downgraded to 'it could happen you know?'). So that's your 'how': care to plump for a 'when'? Plus, it means the club being asset-free tenants, which is not the objective for which they've been asking us to man the barricades as a great leap into the future, commercial stability, and all shortcomings being magically improved.

So do i Me too I have absolutely no contacts within the club or elsewhere to have any 'inside info' (as it patently obvious!) but despite all the winks and confidence elsewhere past history and track record at the Rovers from whatever regime in place gives me absolutely NO confidence at all that the UWE Stadium will be built. We just don't do progress, unfortunately. And if Icon Venues (or whatever they're called) are going to step in, what's the delay? I expect, like other 'takeovers' and 'new investment' stories over the years, nothing will actually ever come to fruition. They may start discussions, they might not. But no deal will ever be secured which eventually delivers a new stadium and bright future for the club we love, as it never has, and never will. There will be some 'positive' or 'encouraging' news leaked from time to time that will enthuse and excite the fans, keep them interested and keep getting bums through the gates, but nothing ever gets finalised, nothing will ever change, and we will have to accept for the rest of days lower league obscurity and mediocrity. Live with it and suck it up. It's the way it always has been and always will.

Only governments build a stadium without any tenants lined up, and the one lane jogging track leaves it a little short of being Olympic standard

We have a very good Uni in Bath crying out for a good running track etc BTW i have NO hard facts that this is going on its just a possible option !

Ah the "When" Word.... in the great scheme of things these things just don't happen do they ! If its going to happen it may take an announcement from the BOD that are pulling out or the contract with the UWE will lapse so the facilities are open for different investment Will it EVER Happen, i'm 50/50 at the moment, before the Sainsbury fiasco started 70/30...

If Rovers sold the Mem to move in to the hypothetical UWE stadium, they would not be asset free. They would have the same net assets as now, only they would be in cash form rather than land.
