They have planning permission for an "employment block" that precedes the Stadium deal. However I've just come from a presentation and that's a potential outcome if it doesn't go through. That said the line was definitely "no other plans" and even after Sainsburys there are still lots of dotting i's and crossing t's to be done.

There is an increasing tendency in the English courts to align with most other jurisdictions in implying a duty of good faith into commercial contracts. I haven't followed the arguments closely at all. But from what I can see from impressions of the people who were at court and have posted on here (many thanks to them) it seems the battleground might be a case that has been alternatively dissed and supported in courts since the judgment was handed down in 2013 (Yam Seng Pte Limited v International Trade Corporation [2013] EWHC 111 [QB] for those who are interested). The judge in that case said that duties of good faith could and should be implied into commercial contracts. It's received broadly favourable comment from judges ever since, but by no means universally. It might be that the judge's decision will centre on her view of that Yam Seng case.

UWE currently have "no other plans" for site. Isn't the reason that Rovers wanted the case heard quickly that UWE were saying that they needed a decision or they had other plans (faculty of law?) for the site?

Well there are 2 outcomes. 1. If she is a Sainsburys shopper then she might find a voucher in her chambers, 2, if she is a Waitrose shopper then we will be ok

Think that is now part of the new Business Centre plans which has started or about to start soon

The new faculty of business and law building is already under construction (I can see it out of my office window now) and has never been reliant on anything to do with the stadium.

At the last Planning meeting with South Glos this very question was asked.. .... ...... ....... Silence is golden by the Tremeloes comes to mind There is a contract between Rovers and the UWE so i'm guessing there is a time limit in it

At last, someone gets it, although in two sentences when one would have been better.

Surely after an almost 2 week break from court duty she's had chance to consider our case?

She might well have other cases under consideration that went before ours and so they've had to take priority.
