If we appeal on this "Inconsistently applied technicality" is any Judge really going to find the contract any less complex and in our favour Surely that is a massive financial risk Also, in all this indignant bluster about appeals, are they forgetting that the reason they gave the High Court that this case should be fast tracked was that UWE wouldn't stay on board if it wasn't resolved by round about now? I hadn't considered that. Best outcome of any appeal would therefore be damages, and I can't imagine how they'd go about calculating our 'loss'. An appeal looks even less attractive in that light.

If you'd all listened to those 'in the know' people from the start you'd be very confident right now ;-) Really is laughable eh Seth. In the know eh lol. So much BS but, like Mr Higgs, convinces themselves they are right. Surely they, likeI, have to realise that the club love to out out disinformation, to people they know will not be able to contain themselves. I don't play that game anymore. I feel sorry for this guy/woman. It is difficult to admit you were wrong but it seems to be a common theme in box 1 and to their Acolytes

One thing I am sure of I would never like to have you in my corner Mr Polak - he who has never tried will never fail because he has no balls There is a time when the best Generals know when to pull back. There is a point where tactical retreat is the only way. Your opinion of me has no bearing on this. It's those that give continued backing, who have given the chairman his air of invincibility and have enabled him. Battles are not won by continuing along a path that has no advantage to be taken. you obviously dont play poker then? It is easy to be critical - and had the decision gone the other way you would have said? The argument has been lost (at the moment) on a technicality, and in time this might prove to have not been all in vain. Lets be thankful Churchill did not pull back in 40's. No doubt you would have advised him to do so.

ITK has been berating posters and sadly for him he has been let down by his "informants"

If we appeal on this "Inconsistently applied technicality" is any Judge really going to find the contract any less complex and in our favour Surely that is a massive financial risk Not when the financial risk is not one that the chairman has to pay. I can't help but wonder, were this his own money at risk, would he have acted in the same manner ? I think Higgs has got to the point where the borrowing from the capital company has made him feel that he HAS to pursue this. I had my view on him anyway but this just goes way OTT of what I thought him capable of. I don't think even our fans can tolerate years of more appeals but, more importantly, surely the UWE will not allow this to carry on. By the time any appeal was heard and even won, the whole reason to go through this? Will no longer be available. I think many have lost perspective of this. IF Nick Higgs is or was telling the truth then UWE will shut the chance down in any case. Whatever happens? The project is dead. What reason is there to risk more money and the club when there will be no stadium to build ?

No doubt you would have advised him to do so. It's a moot point as any appeal will not keep UWE onboard. Can you not see this is now just about ego ? as for Churchill, I could tear that to shreds, given my family history it's something I have studied to the point of silliness. This is about the very existence of the club, sometimes you have to look at the bigger picture and not about someone trying to trying to cover up his own mess. I just feel gutted right now & don't want to get into point scoring here.

I don't understand what difference it makes to people that we are said to have lost on a 'technicality'. The 'technicality' is a term of the contract.

If UWE pull the plug then that would be a thousand times worse news than Sainsbury's winning today's case. We don't need UWE, all we need is a competant BoD and to slowly develop the ground we already have. Or, If I were investing I would be looking long and hard at that land opposite Filton Airport, much better site than UWE. There is no Plan B, if there were that would be Higgs' focus today, not whinging on about losing the case on a technicallity. Which bit doesn't he understand, the whole point was to argue those technicalities and to convince Judy that they were the very reasons that the contract should be enforced.

Unless someone can find a spare £30+ million it won't make any difference. It's not £30m, The Mem still has a value. True, but the thought of another 4 year wait to get another scheme through planning permission, etc.etc.etc. would surely lead to UWE moving on.

It wouldn't take 4 years to get planning permission for a residential development which would bring in c£15m. The important thing is that the value of The Mem remains part of the football club and does not get used to repay the incompetent fools who have risked all to achieve nothing.

I don't think it ever was, but Higgs' writ confirmed that the build price has now increased. And Wonga are going to want paying, that'll be another £2m that has to come from somewhere.

I don't disagree with your assertion that the Mem remains an asset. But 40 years of frustration in getting a new stadium built shakes my belief in getting anything done quickly as far as Rovers is concerned.
